On February 7, 2017, the United States Ninth Circuit Court of Appeals heard oral argument in the initial appeal of the TRO entered by the district court in Washington v. Trump, the case involving the President’s executive order on immigration. Two days later, the Court rendered an opinion, rejecting the administration’s appeal and leaving the stay order in place pending discovery, hearing, briefing, and a decision on the application for preliminary injunction. This CLE will examine various procedural and substantive rulings reflected in the Ninth Circuit’s opinion as well as the effectiveness of counsel’s performance during oral argument.
