Software is both ubiquitous and largely misunderstood, leaving developers, end-users, c-suite professionals, and, yes, even lawyers with very different notions of what exactly that term entails. This confusion has spilled into software’s legal treatment and has obscured notions of software “ownership.” As a result, clients have needed attorneys to navigate a complicated legal landscape when they seek to develop or leverage software for their business purposes. Seven years ago, the US Supreme Court’s landmark decision in Alice Corp. v. CLS Bank made this task more challenging by clouding software’s eligibility for patent protection. Since then, USPTO guidelines and caselaw have shed some light on the subject, but counseling clients on the right strategy for software protection remains tricky.
