The panel will address issues surrounding the initiation of an MDL, including what and how to argue your position to the JPML, as well as JPML considerations about whether to form an MDL and, if so, where to centralize it. The panel will then turn to some of the more recent developments that various district courts have used to efficiently manage MDLs, such as requiring an initial census, settlement committees and negotiation classes, and the use of special masters. Finally, the panel will discuss the benefits and challenges of the bellwether trial and the more recent trend of MDLs not completely resolving litigation and remanding cases to the district courts from which they were transferred.
